III. LOCAL CONSULTATION
Local impacts of projects or programs necessitate reinforced environmental dialogue. The Notre-Dame-des-Landes airport project highlights democratic deficiencies in infrastructure development. Triggered by Article 106 of the Macron Law, Ordinance n° 2016-488 introduces Chapter III bis to the Environmental Code titled "Local Consultation on Environmentally Impactful Projects". It is complemented by Decree n° 2016-491 detailing local consultation applications.
The State can consult voters from a specified territorial area regarding environmental impacts of infrastructure projects. The ordinance broadens local consultation, initially confined to preliminary decision-making stages. Examination by the Council of State's judges confirmed the legality of post-public utility declaration consultations.
The consultation area includes the territory of affected public inquiries or impacted municipalities. Open to EU nationals on electoral lists, consultations are government-decided with specifics published at least two months prior. Mayors inform citizens and organize consultations, providing information electronically or on paper. Voters express their stance via "YES" or "NO." A recount commission tallies and announces outcomes, resolving any vote count discrepancies.
